1.¿Who collects your Personal Data?
Celebri-3, S. de R.L. de C.V., is a Mexican company, duly incorporated and governed under the laws of the United Mexican States, including its affiliated companies or subsidiaries (hereinafter “Pharma2Help®”), with address to hear and receive notifications at [email protected]; is the person in charge of processing the personal data that has been provided by the Owners to whom they correspond.
For the purposes of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de Particulares (the “LFPDPPP”) and other applicable legislation, this Privacy Notice (hereinafter “Notice”) establishes the terms and conditions whereas the treatment of the personal data of the Owners is conducted.
This Site is intended to be used only by residents of the United States of America and the obligated subject as Responsible for Personal Data, is governed by the laws and regulations of the United Mexican States. If you are a citizen of the European Economic Area (EEA), the United States of America, or another jurisdiction outside of the United States of America, please note that in order to provide products and services to you on our Site, we may use, ship, and store your personal information (also commonly known as personal data, or PHI under laws such as HIPAA, or whatever it is called under GDPR and other foreign laws) outside the EEA, including the United States, mainly in Mexico, which is the center of business from Pharma2Help. Accordingly, your personal information may be transferred outside of the country in which you reside or are located, including to countries that may or may not provide the same level of protection for your personal information. We are committed to protecting the privacy and confidentiality of personal information when it is transferred in pursuance with Mexican law. Where such transfers occur, we take appropriate steps to provide the same level of protection for processing carried out in any of the EEA countries or the United States of America to the extent possible under applicable law. By using and accessing our Site, users who reside or are located in or outside the United States of America, the EEA, but are citizens or nationals, accept and consent to the transfer and processing of personal information on servers located outside the country where they reside, and that the protection of such information may be different from that required by the laws of your residence or location.
We use standard physical, technical, and administrative security measures and safeguards related to the medical industry to protect the confidentiality and security of your personal information, using best efforts and reasonable measures. However, because the Internet is not a 100% secure environment, we cannot guarantee, warrant, or guarantee the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach, or even disclosure, of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that email and other communications you send to us through our Site are not fully encrypted, and we strongly recommend that you do not communicate any sensitive information through these means. It is understood that medical prescriptions with sensitive information can be sent by this means or email. Pharma2Help will make its best efforts so that said information is not compromised or disclosed, in proportion to the scope of Mexican Law.
The Owner declares (i) that this Notice has been acknowledged to him by the Responsible Party, (ii) having read, understood and agreed to the terms set forth in this Notice, whereas he/she grants his/her consent regarding the processing of his/her personal data. In the event that the personal data collected includes property or financial data, by signing the corresponding contract, whether in printed format or using electronic means and their corresponding processes for the consent execution, acts that constitute such express consent of the user will be carried out; and (iii) that the Owner gives his consent for the Responsible Party to transfer and/or send personal data in accordance with the provisions of section 5 of this Notice.
2. Which Personal Data we process?
Pharma2Help may collect personal data from the Owner through direct and/or personal delivery by any means of contact between the Owner and the Responsible Party. It may also collect personal data indirectly through publicly accessible sources and other resources available on the market.
To carry out the purposes described in this Notice, Pharma2Help will process personal identification data, contact data and property and/or financial data. Likewise, will be processing sensitive data related to the products that it markets that could reveal aspects concerning the health status of the Owner and in some of his biometric data, which will be duly safeguarded and will only be disclosed with express consent, with the exception of the provisions of the Law.
3. What purpose we pursue by processing your Personal Data?
Primary purposes. Pharma2Help will process the personal data of the Owner with the purpose of complying with the obligations originated and derived from any legal and commercial relationship executed due to the elaboration, production, commercialization, distribution, import and export of different goods and the provision of the related services that the Owner requests (together referred to as the “Products”); to facilitate the supply of medicines; to carry out payment processes; online sales; billing; collection; credit; customer contact; attention to requests, clarifications, suggestions, refunds and administration of Web sites and computer applications. Additionally, for activities related to access control and safeguard of material and human resources within the facilities of the Responsible Party.
Secondary purposes. Pharma2Help will process the Owner’s personal data for other purposes that allow and facilitate providing better care, as well as products specifically tailored to their preferences and needs. These purposes are sending notifications of offers, notices and/or promotional messages; communications for marketing, advertising or telemarketing purposes about new or existing products and services whether they are our own or those of business partners; newsletter subscription; conducting surveys; statistics; market studies, history and records on consumption habits, interests and behavior through automatic data capture tools; implementation of loyalty programs, benefits and incentives; participation in social networks, chats and/or discussion forums; participation in events, trivia, contests, raffles, games and sweepstakes; evaluation on the quality of products; and in general, for any activity aimed at promoting, maintaining, improving and evaluating the products.
You are entitled to oppose the processing of your data for secondary purposes through the means made available to you for the exercise of your ARCO rights (rights to access, rectification, cancellation and opposition). If you do not object within a period of five business days after your data was collected, it shall be understood that your consent has been granted thoroughly.
4. To whom will we be sharing your Personal Data?
Pharma2Help does not sell, assign, transfer, rent or make available personal information to third parties, collected for the aforementioned purposes, at the time of registration or when making transactions with its servers.
The databases are not shared with third parties except for well-founded and reasoned requirements of the competent judicial authority in accordance with the LFPDPPP.
Pharma2Help needs to share the personal data of the Owner in order to comply with its legal and/or commercial obligations, whereas it has entered into or will enter into various commercial agreements in Mexican territory. The recipients of the personal data are construed by virtue of the corresponding agreement, to maintain the confidentiality of the personal data provided and to observe this Notice. Pharma2Help may communicate the personal data collected to any other company of the same business group to which the Responsible Party belongs and that operates with the same processes and internal policies, for its treatment with the same purposes as described in this Notice.
5. How you exercise the right to access, rectify, cancel or oppose to the processing of your Personal Data?
You may at any time exercise your ARCO rights (access, rectification, cancellation or opposition) regarding your personal data by submitting a request in the format that we will deliver you for this purpose, which shall contain at least the following information and documentation:
• Name of the Owner and address or other means to communicate the response to your request;
• Current documents that prove your identity (simple copy in printed or electronic format of your voter card, passport or Forms FM2 or FM3, or other official identifications in the United States of America, such as a driver’s license, social security card and others with photograph and name, issued by government authorities) or, where appropriate, the legal representation of the Owner (simple copy in printed or electronic format of the simple power of attorney with autograph signature of the Owner, the agent and their corresponding valid official identifications: voter identification card, passport or FM2 or FM3 Forms, as well as official identifications in the United States of America, such as a driver’s license, social security card and others with a photograph and name, issued by government authorities);
• The clear and precise description of the data whereas you seek to exercise any of the ARCO Rights, and
• Any other element or document that facilitates the location of the Owner’s personal data.
In the case of requests for rectification of personal data, the Owner must also indicate the modifications to be made and provide the documentation that supports their request.
To comply with the obligation to access your personal data, it will be approved previous evidence of the identity of the owner or personality of the representative; making thereafter available the information at the address of the Responsible Party. Another means may be agreed between the Owner and the Responsible Party, provided that the information requested so allows.
You hereby state that you understand that there will be events in which Pharma2Help is prevented from processing any ARCO right, based on compliance with a legal obligation or when necessary for your medical care.
To exercise your ARCO rights, the revocation of your consent and the other rights provided for in the LFPDPPP, a free custom letter addressed to us is required. Regarding the latter, we put at your disposal the following means:

Pharma2Help will resolve the query to the Owner within a maximum period of twenty business days, since the date on which the request was received so that, if applicable, is possible for the Responsible Party to make effective such resolution within fifteen business days after the response is communicated. In all cases, the response will be noticed by the same means of the request submission or, where appropriate, by any other means agreed with the Owner. The aforementioned terms may be extended in terms of the LFPDPPP.
6. How are you entitled to limit in any manner the processing and disclosure of your Personal Data?
Pharma2Help will keep the personal data of the Owner for as long as necessary to process their requests for information and the products they request, as well as to maintain accounting, financial and auditing records in terms of the LFPDPPP and the commercial, tax, administrative and any other regulation in force that applies.
The personal data collected will be protected by adequate administrative, technical and physical security measures against damage, loss, alteration, destruction or unauthorized use, access or processing, in accordance with the provisions of the LFPDPPP and other applicable legislation. However, Pharma2Help does not guarantee that unauthorized third parties may not have access to the physical or logical systems of the Owner or the Responsible Party or to the electronic documents and files stored in their systems. Consequently, Pharma2Help will not be liable in any way for damages that may arise from said unauthorized access.
You or your duly accredited legal representative may limit the use or disclosure of your personal data through the same means and procedures provided for the exercise of ARCO Rights. If your request is valid, you will be registered in the exclusion list arranged by Pharma2Help to stop receiving information related to advertising or marketing campaigns. The request may be denied if the information is necessary to provide you with a service or sell you a product, without liability to Pharma2Help.
In the event that you consider that in any way we have violated your right to the protection of your personal data, you can go to the National Institute of Transparency, Access to Information and Protection of Personal Data (Instituto Nacional de Acceso a la Información, “INAI”).
7. What data we collect when you navigate our site and webpages?
Pharma2Help may collect data through its websites, or through the use of automatic data capture tools. These tools allow you to collect the information that your browser sends to said Web sites, such as the type of browser you use, the user language, access times, and the IP address of Web sites that you used to access the site of Pharma2Help.
Among the automatic data capture tools used on our sites and web pages are cookies, Web beacons, and links in emails.
Use of Cookies.- The proper functioning of the Pharma2Help sites requires the enabling of “cookies” in your Internet browser. “Cookies” are small data files transferred by the Web site to your computer’s hard drive when you browse the site. In most browsers cookies are automatically accepted by virtue of their default settings, and you can adjust your browser preferences to accept or reject cookies. Disabling cookies may disable various features of Pharma2Help websites or may not display them correctly. In case you prefer to delete cookies, you can delete the file at the end of each browser session.
Use of Web beacons.- Also known as Internet tags, pixel tags and clear GIFs. Pharma2Help may use Web beacons, alone or in combination with cookies, on its websites and in its HTML-formatted emails to collect information about the use of the websites and your interaction with email. The Web beacon is an electronic image, called a single pixel (1×1) or GIF that can recognize information that is processed on your computer, such as cookies, the time and date that the site and its sections are viewed.
Links in Pharma2Help emails.- Emails may include links that allow Pharma2Help to know if you activated said link and visited the destined web page, and this information may be included in your profile. They may also include links designed to direct you to relevant sections of the Websites, by redirecting you through Pharma2Help’s servers, as the redirection system allows you to determine the effectiveness of online marketing campaigns. In this act, you acknowledge that emails are not the safest notification mechanisms, for which Pharma2Help is released from any responsibility arising from your consent, that you wish to receive electronic communications, and that your information is known to you within the scope of such communications.
Protection of minors, persons in a state of interdiction or disability.- We encourage parents and/or guardians to take an active role in the online activities of their children or represented. In the event that you consider that the personal data has been provided by a minor or by a person in a state of interdiction or disability, in contravention of this Notice, please send an email to the address: [email protected] so that we can proceed to eliminate such data personal in an immediate fashion.
8. How to be noticed of amendments to this Privacy Notice?
This privacy notice may undergo amendments, changes or updates derived from new legal requirements; of our own needs for the products we offer; of our privacy practices; alterations in our business model, or other causes.
